The High Learn site is owned, edited, and run by High Learn. High Learn is a company based at 278 Langham Road, London N15 3NP.

Acceptance of these Terms and Conditions is required in order to use the High Learn website. You acknowledge that you will frequently refer to the most recent version of the General Conditions posted on the site by using High Learn.

High Learn reserves the right to revoke or restrict access to the site in the event that a user violates these terms or acts in an unacceptable manner toward another user.

Tutors

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Students and Child Protection

High Learn strives to offer the best support and a secure environment for learning for kids.

Both on and off the Website, students are solely responsible for their own actions.

Student Data

You permit High Learn to use the student data for the following purposes by submitting, granting us access to, or causing it to come into our possession:

  •  (i) providing the Service.
  • (ii) developing and bettering our Service
  • (iii) upholding our rights as outlined in these Terms.
  • iv) as permitted with the User’s permission.

Disclosure of Student Data and Third-Party Service Providers

You understand and agree that High Learn may give our employees and service providers who need access to Student Data in order to perform tasks for us a legal right to do so. The confidentiality of any Student Data handled, transmitted, or processed by us, our staff members, affiliates, service providers, or agents will be upheld. Other than as stated in this Agreement and the High Learn Privacy Policy, or with a parent’s permission, High Learn shall not disclose Student Data to third parties.

Payments (Failure to Pay) & Cancellation


[The [Plan] outlines the payment terms for the fees associated with the software packages and tutoring services provided under the [Support Agreement]. The Customer shall be in default under this Agreement if any amount due to the Company is not paid within 30 days of the due date as specified in this Agreement. The Company may suspend access to the High Learn system in the event of such a default up until such default has been corrected by the Customer without violating this Agreement or waiving its right to the Minimum Fees due hereunder.

The Customer shall pay all collection costs incurred by the Company, including actual legal fees on an own client basis and the cost of any action commenced by the Company in a court of competent jurisdiction to recover such amount. In addition, the Company may retain a collection agency or a legal representative for the collection of the amount due under this agreement.

Restricted Access

Our website has some areas that are restricted in access.  At our discretion, we reserve the right to restrict access to other parts of our website or even the entire website.

You are responsible for keeping your user ID and password private if we give them to you so you can access password-restricted areas of our website or other content or services.

In our sole discretion, we may disable your user ID and password without prior warning or justification.

We will deactivate your user ID if you reveal your username or password.

Regular Changes

Our website will be regularly updated, and the content may change at any time. We reserve the right to temporarily restrict access to our website or permanently shut it down. We make no commitment to update any of the content on our site, so it may be out of date at any time.

Indemnity

You hereby agree to hold us harmless from any losses, damages, costs, liabilities, and expenses (including, without limitation, legal fees and any amounts paid by us to a third party in settlement of a claim or dispute on the recommendation of our legal advisers), incurred or suffered by us as a result of any violation by you of any term or condition of this agreement, or as a result of any claim that you have violated any term or condition of this agreement

Breaches of These Terms and Conditions

Without limiting our other rights under these terms and conditions, if you violate any of them, we may take whatever action we deem necessary to remedy the situation, which may include blocking your access to the website, preventing you from accessing it, preventing computers using your IP address from accessing the website, contacting your internet service provider to ask them to do so, and/or bringing legal action.

Variation

Assigment

Entire Agreement

These terms and conditions completely replace any prior agreements regarding your use of our website and represent the agreement between you and us regarding that use.

Law and Jurisdiction

Any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of England [AND LAWYER], and they will be governed by and construed in accordance with English law.
